These Terms are available in English and Thai. In the event of any inconsistency between the two versions, the English version shall prevail.

1. About These Terms

These Website Terms of Use (the “Terms”) govern your access to and use of the website at www.flowenco.com (the “Website”), operated by Flowen Co., Ltd. (“Flowen,” “we,” “us,” or “our”), a company incorporated under the laws of Thailand with its registered office at 22/103 Klong Lum Chiak Rd., Nawamin, Bueng Kum, Bangkok 10230.

By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

2. Website Only: Platform Services Are Governed Separately

These Terms apply only to the Website. Access to and use of the Flowen behavioral AI debt collection platform and related services (the “Platform Services”) are governed exclusively by the applicable Service Agreement, the Flowen Platform Terms of Service and any Data Processing Agreement executed between Flowen and its clients.

Nothing on the Website constitutes an offer, a binding commitment to provide any service, or part of any contract between you and Flowen.

3. Information on the Website and No Guarantee of Results

The content of the Website is provided for general information purposes only. While we aim to keep it accurate and up to date, we make no representation that it is complete, accurate or current.

All projections, benchmarks, statistics and performance metrics shown on the Website, including figures relating to collection cost reduction, repayment rates or uplift compared with manual collections, are illustrative only. They may be based on internal analyses, pilot results or industry benchmarks and do not constitute a warranty, representation or guarantee of any specific recovery rate, repayment amount or collection outcome.

Nothing on the Website constitutes legal, regulatory, compliance, credit or financial advice. Any risk scores or analytics described on the Website are not credit assessments or credit ratings.

4. Intellectual Property

Flowen and its licensors retain all right, title and interest in and to the Website and its content, including text, graphics, logos, the “Flowen” name and brand, software, designs and other materials (“Website Content”).

You may view and print Website Content for your own internal, non-commercial reference only. You may not copy, reproduce, modify, distribute, publish, create derivative works from, or otherwise use any Website Content, or any Flowen trade mark or logo, without our prior written consent.

5. Acceptable Use

You must not, and must not permit any third party to:

  • attempt to gain unauthorised access to the Website, its servers or any related systems or infrastructure;
  • upload, transmit or introduce any virus, malware, ransomware, trojan, worm or other harmful code;
  • interfere with or disrupt the integrity, performance or availability of the Website, including through denial-of-service attacks;
  • use any robot, scraper or other automated means to access, copy or extract Website Content, except for standard search engine indexing;
  • reverse engineer, decompile or otherwise attempt to derive the source code or underlying technology of the Website;
  • submit false or misleading information, or personal data of another person without proper authority, through the Website; or
  • use the Website in any manner that violates applicable law.

6. Enquiries and Personal Data

Personal data you submit through the Website, including through our contact form, is processed in accordance with our Privacy Notice.

Please do not submit confidential or sensitive information through the contact form. Submitting an enquiry does not create a client relationship or any obligation on Flowen to provide services.

8. Disclaimer

To the maximum extent permitted by applicable law, the Website and all Website Content are provided on an “as is” and “as available” basis. Flowen disclaims all warranties, whether express, implied, statutory or otherwise, including any warranty that the Website will be uninterrupted, error-free, secure or free from viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Flowen shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, business opportunity or goodwill, arising out of or in connection with your access to, use of, or inability to use the Website or any Website Content, or your reliance on any information on the Website, even if Flowen has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from fraud or gross negligence.

10. Changes to These Terms and the Website

We may update these Terms from time to time. The updated Terms will be published on the Website with a revised Effective Date and will apply from the date of publication. We may also change, suspend or discontinue any part of the Website at any time without notice.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms or the Website shall be submitted to the exclusive jurisdiction of the competent courts of Thailand.

12. General

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. No failure or delay by Flowen in exercising any right under these Terms shall operate as a waiver of that right.
